1. Introduction and Acceptance of Terms
Welcome to EduEire! These Terms & Conditions (“Terms”) govern your access to and use of the EduEire website and services, which are provided by Easy AI Ltd (CRO 772816), an Irish company trading as EduEire. By creating an account or using any part of the EduEire platform, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our service.
These Terms form a legally binding agreement between you (the “User” or “Member”) and Easy AI Ltd/EduEire (referred to as “we”, “us”, or “our”). We recommend that you read these Terms carefully and save a copy for your records. Our Privacy Policy (provided above) is incorporated by reference into these Terms, meaning that by agreeing to these Terms, you also agree to how we collect and use your data as described in the Privacy Policy.
EduEire is an AI-powered suite of tools to support teachers with planning, assessment, reporting, and administrative tasks. Currently, our primary live feature is a lesson plan generator aligned with the Irish curriculum, with additional features in development. We provide this service to you subject to the following terms and conditions:
2. Eligibility and Account Registration

Eligibility: EduEire is intended for adult educators (such as teachers) and other users interested in educational planning. By using this service, you confirm that you are at least 16 years old (the age of digital consent in Ireland) or older. The platform is not intended for use by children or students for their own accounts. If you are using EduEire on behalf of an organization (like a school or training center), you also confirm you have authority to agree to these Terms on its behalf.

Account Creation: To access most features, you must create an account with a valid email address and secure password. You agree to provide truthful, accurate, and complete information during registration (for example, your name and a contact email). You are responsible for keeping your account information up to date.

Account Security: You are responsible for maintaining the confidentiality of your account login credentials. Do not share your password or account access with others. If you suspect any unauthorized use of your account or a security breach, you must promptly notify us at support@edueire.ie. We recommend using a strong, unique password and changing it periodically for security.

Account Use: Each account is meant for a single user. Sharing accounts is not permitted. For group or school subscriptions, each individual teacher or authorized user should have their own login (we offer multi-user options for institutions). You agree not to misrepresent your identity or affiliation when using the platform. Impersonating another person or entity, or using another user’s account, is strictly prohibited.

Multiple Accounts: You may not create multiple accounts to circumvent trial limits or other restrictions. For example, if a 7-day free trial is offered, each person or organization is entitled to only one trial unless otherwise stated. Creating fake accounts or disposable emails to gain additional free usage is a violation of these Terms.
We reserve the right to refuse registration, cancel accounts, or reclaim usernames (for example, if they are inappropriate or violate someone’s rights). We may also suspend or terminate accounts that we find to be in breach of these Terms, as described in Section 10 (Termination).
3. Subscription Plans and Payments
EduEire operates on a subscription-based model to provide ongoing access to our AI tools:

Plan Options: We offer monthly and yearly subscription plans for individual teachers, as well as multi-user plans for schools or educational organizations (e.g., group licenses through Education and Training Boards). Pricing information (e.g. monthly rate or annual rate) is available on our website or through the Wix billing interface when you subscribe. All prices are stated in Euro (€) unless otherwise noted. (Note: Specific pricing details are subject to change and are provided at sign-up; we won’t list all plan prices here in the Terms.)

Free Trials / Freemium Access: We may offer a free trial period (for example, 7 days of free access) or a freemium model to let you try EduEire. Trial users will have access to the platform’s features as if they were subscribers, and these Terms apply equally to trial users. After the trial period, if you do not subscribe to a paid plan, your access to premium features may end or be limited. We reserve the right to define trial conditions (such as one trial per user) and to modify or discontinue trial offers at any time.

Payment Process: Subscription payments are handled via our website’s payment system (powered by Wix and its payment partners). By subscribing, you authorize us or our payment processor to charge the applicable subscription fee to your provided payment method. For yearly plans, the full annual fee is charged upfront; for monthly plans, the fee is charged each month. All subscriptions are set to auto-renew by default to ensure uninterrupted service.

Auto-Renewal and Cancellation: Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle (monthly or yearly) and your payment method will be charged, unless you cancel beforehand. Cancellation: You can cancel your subscription at any time through your account settings or by contacting us. If you cancel, you will continue to have access to the premium features until the end of your current paid period. After that, your account may revert to a free/basic access (if available) or be deactivated from premium services. We do not typically provide refunds or credits for partial subscription periods or unused time after cancellation, except where required by law or at our discretion in extraordinary cases.

Failed Payments: It is your responsibility to ensure your payment information is current and has sufficient funds. If a charge is declined or fails, we may attempt to reprocess it, but if payment remains unpaid, we reserve the right to suspend or downgrade your account until payment is resolved. We will notify you of any payment issues so you have a chance to update your information.

Changes to Fees: Our subscription fees may change over time (for example, as we add new features). Any fee changes will be communicated to you in advance. For existing subscribers, new prices will apply starting from your next billing cycle after the change takes effect. If you do not agree to a fee change, you may cancel your subscription before the new rate applies. Continuing to use the service after the price change constitutes acceptance of the new prices.

Taxes: All fees are inclusive of any applicable taxes unless stated otherwise. If any taxes (e.g., VAT) are required to be collected, we or our payment processor will add those to the charges as required by local laws.

4. EduEire Services and Usage
EduEire provides a set of online AI-driven tools to aid teaching-related tasks. By using our services, you agree to the following terms of use:

Permitted Use of Outputs: EduEire generates content such as lesson plans, schemes of work, assessment items, or reports (depending on features available). We grant you a broad license to use, edit, and share the outputs for your personal or professional educational purposes. This means you are free to use the lesson plans in your own classroom, share them with colleagues or students, or adapt them to suit your needs. You may also store or print them for later use. However, you may not sell or commercially resell the outputs generated by EduEire. For example, you should not compile EduEire-generated lesson plans into a book or app for sale, or charge others for access to the raw outputs. The intent is that the content is a helpful aid for educators, not a product to be monetized by third parties.

Non-Transferable Service License: We give you a personal, non-exclusive, non-transferable, revocable license to access and use the EduEire platform and its content, subject to these Terms. You agree not to copy, reproduce, distribute, or create derivative works from the platform itself. In other words, while you can share and use the lesson plans you get (as per above), you cannot redistribute our service or any part of our databases, AI models, or underlying code. For instance, you cannot scrape our curriculum database or use our interface to provide a competing service.

AI-generated Content: You understand that content on EduEire is generated by artificial intelligence based on the inputs you provide and the data we have integrated (such as the Irish curriculum). While we aim for high-quality, curriculum-aligned outputs, AI generation may occasionally produce errors, outdated information, or unintended results. You as the educator are responsible for reviewing the content. Always double-check crucial details (like factual information or curriculum alignments) before relying on the output in a high-stakes context. EduEire is a tool to assist you, not a replacement for your professional judgment.

Updates and New Features: EduEire is continuously evolving. We may add, modify, or remove features as we develop the platform (for example, introducing a scheme-of-work builder or collaborative planning space). These Terms will apply to new features as they are rolled out. Major changes or new services might come with additional terms or updates to these Terms, which we will communicate to you. Using a new or modified feature after such notice constitutes acceptance of any updated terms governing that feature.

5. Acceptable Use and User Obligations
We expect users to use EduEire responsibly and ethically. By using our platform, you agree to the following acceptable use rules and obligations:

No Illegal or Harmful Use: You will not use EduEire to engage in any unlawful activities or to promote illegal acts. This includes, but is not limited to, refraining from using the platform to generate content that is defamatory, harassing, discriminatory, hateful, or that incites violence or illegal behavior. The platform should not be used to create or spread content that violates any applicable laws or regulations.

Respect Intellectual Property: You will not use EduEire to violate intellectual property rights. Do not input material that you do not have the right to use (for example, proprietary text from textbooks or copyrighted material that isn’t yours) expecting the AI to process or rephrase it — while our AI doesn’t simply copy-paste, any generation that too closely mirrors protected content could be problematic. Similarly, if the output includes portions of curriculum or other data, you may use it for teaching, but do not claim those specific portions as your original work if they are substantially quoted from official sources. Our system is designed to use public curriculum information, but always ensure you attribute any official text (like exact wording of curriculum outcomes) if required by your context.

No Abuse of the System: You agree not to misuse EduEire in ways that could harm our service or other users. This includes:

Spamming or Overloading: Do not attempt to overwhelm the system with automated queries, excessive requests, or any form of “spam” input that is not for legitimate educational use. We may implement rate limits; you must not try to bypass them or use bots to mass-generate content.

Security Interference: Do not probe, scan, or test the vulnerability of our system or networks. No hacking, decompiling, reverse engineering, or otherwise tampering with EduEire’s software, code, or data is allowed. You also must not introduce any malicious software (viruses, worms, malware) or engage in any activities that disrupt the service or compromise security.

Circumventing Access Controls: Do not attempt to access accounts or data that you are not authorized to access. This includes not trying to use another user’s credentials, not using any non-public areas of the site, and not attempting to discover source code or algorithms by illicit means.

User Content and Input: Some upcoming features may allow you to upload or save your own content (for example, attaching resources to a lesson plan, or writing notes). In such cases, you retain ownership of content you create and upload. However, you grant us a license to use that content as necessary to provide the service (e.g., storing it, displaying it to you, or if you choose to share it with colleagues through a future collaboration feature). You are responsible that any content you add does not violate any laws or rights of others. Do not upload personal data of others (especially minors) without proper consent. Do not upload content that is obscene, defamatory, or otherwise objectionable. We do not pre-screen user content, but we reserve the right to remove or disable access to any content that we deem violates these Terms or is harmful.

No Account Sharing or Reselling: As mentioned, sharing your login is not allowed. Likewise, you may not resell or sub-license the service to others. For instance, you cannot charge others to use your EduEire account, nor can you package our service within another product without permission. If you are an institution and want multiple users, please use an official multi-user plan rather than account sharing.

Feedback: We welcome feedback and suggestions to improve EduEire. If you provide feedback, you agree that we may use it without restriction or compensation to you, and that we own any improvements or new features that may result. (For example, if you suggest a new feature and we implement it, we will own that feature – but we certainly appreciate your input and will acknowledge users generally for helping us improve.)
Failure to adhere to these acceptable use rules can result in suspension or termination of your account, and in serious cases, legal action. We also reserve the right to report any illegal activities to law enforcement.
6. Intellectual Property Rights

Our Intellectual Property: EduEire (including all content on our site, the design, text, graphics, logos, software code, algorithms, underlying databases, and the compilation of data such as our structured curriculum content) is the intellectual property of Easy AI Ltd or its licensors. The EduEire name and logo are our trademarks. All these are protected by intellectual property laws. You are not granted any ownership of these IP rights by using the service. You agree not to remove or alter any copyright notices, trademarks, or other proprietary markings on the site or outputs where they might appear. (Note: Currently, lesson plan outputs may not carry explicit branding in the Word document, but this clause covers any such branding or notices that might be present.)

License to Use Outputs: As stated, we grant you a license to use the AI-generated outputs for your professional and personal use. To the extent that any output from the AI is capable of being copyrighted or owned, we disclaim ownership of the creative content generated for you and assign any such rights to you as the user, free and clear, for your own use. This means you can further develop or modify the lesson plans or content as you wish without fear that we will claim it as ours. However, be mindful that if an output contains pre-existing content (like a verbatim curriculum outcome or a well-known text excerpt), our assignment doesn’t affect the original rights of those materials. In simpler terms: you own what you create with EduEire, but that doesn’t grant you rights to things that were already copyrighted by someone else and maybe included in the output. Generally, curriculum standards are public or government-published, so using them is fine.

Your Content and Data: You retain all rights to content you input into EduEire (such as your prompts or any custom materials you upload in the future). By using our service, you give us permission to use, store, and process your content for the purpose of providing the service (including displaying it back to you, analyzing it to improve results, etc.). This license is necessary for us to run the service and ends when you delete the content or your account (except for backups or legal record-keeping as described in the Privacy Policy). We do not claim any ownership over your original teaching materials or ideas that you may integrate with our outputs.

Third-Party Content: Our platform might include references or links to third-party resources (for example, if a lesson plan includes a hyperlink to an external educational video or if our website links to curriculum documents). We do not claim ownership of any third-party content that the AI might include or suggest. Those remain the property of their respective owners. Use of third-party links or resources is at your own discretion and may be subject to the terms of those third-party sites. We aren’t responsible for content on external sites.

AI and Data Rights: We want to be transparent that behind EduEire’s outputs is a combination of our custom curriculum data and OpenAI’s AI models. We have a license to use OpenAI’s technology, and we combine it with our data and templates. All the custom parts (like how we structure Irish curriculum data or the templates for lesson plans) are our intellectual property. The AI model itself is proprietary to OpenAI. You won’t attempt to extract the underlying model or data through output analysis (often called “model extraction” attacks), as that would violate both our rights and OpenAI’s rights. Using the service as intended (to generate teaching content) is of course fine.

EduEire Marks: You may not use “EduEire” or our logos without our permission in a way that suggests endorsement or partnership. For example, you can’t name your own product “EduEire Lesson Bank” or use our logo on your website as if you are affiliated. If you want to mention or review EduEire (which we welcome), ensure it’s clear that the trademark is ours and your usage is just nominative (simply referring to us). If in doubt, contact us for guidance.

7. Disclaimer of Warranties
EduEire is designed to assist and enhance your teaching workflow, but we want to be clear about how the service is provided:

“As Is” and “As Available”: EduEire is provided on an “as is” and “as available” basis. While we strive for high quality and reliability, we do not guarantee that the service will be uninterrupted, error-free, or meet all of your expectations. The nature of AI means results can vary. You acknowledge that using an AI tool involves some unpredictability in output.

No Guaranteed Results or Accuracy: We make no warranty that the lesson plans or other content generated will be perfectly suited to your needs, completely accurate, or in full compliance with all curriculum requirements (though we aim for that). For example, while we align content with Ireland’s official curriculum, it remains your responsibility to verify that a generated plan fits your specific class context or the latest curriculum updates. We do not warrant that any learning outcomes, activities, or assessments suggested will guarantee any particular result in student performance or satisfy any inspector or administration without your own review and adjustments.

Fitness for a Particular Purpose: You assume full responsibility for how you use the outputs from EduEire. We disclaim any implied warranty of fitness for a particular purpose. In practice, this means we can’t promise that EduEire will solve all your planning problems or, say, that using our lesson plans will ensure you pass an evaluation. The tool is meant to help, but it’s not a certified curriculum authority. Always use your professional judgment.

Technical Reliability: Although we employ modern security and hosting, we don’t guarantee that the platform will always be secure or free from bugs or viruses. You should use your own virus protection software and take standard precautions (for example, when downloading a Word lesson plan file, it’s extremely unlikely but still prudent to have antivirus in general).

Third-Party Services: We rely on third-party services (like OpenAI and Wix). We cannot guarantee these external services won’t have outages or issues. Any statements regarding uptime or availability are targets, not hard guarantees. For example, if OpenAI’s API is down, EduEire might not be able to generate content temporarily. We will do our best to inform users and resolve issues, but we aren’t liable for downtime or data loss stemming from third-party failures.

No Professional Advice: The content generated by EduEire (lesson plans, suggestions, etc.) should not be considered official pedagogical or legal advice. EduEire is a tool to augment your planning, but it does not replace the need for professional discretion. If you have specific teaching obligations or special education needs to consider, treat the AI’s output as a draft or aid, not a conclusive authority. Similarly, any guidance our team may provide (like support answers to questions about how to use the platform) is given in good faith but without any warranty.

Beta Features: If you are using a beta feature or during a trial phase, you acknowledge the software might be in development. Beta features are provided “as is” without any warranties and might be changed or removed after testing.
In summary, to the fullest extent permitted by law, we disclaim all warranties (express or implied) regarding EduEire and its content, except those expressly stated in these Terms. Some jurisdictions don’t allow certain warranty disclaimers, so if you are a consumer, you may have additional rights. Nothing in this section affects any statutory warranties that cannot be excluded or limited under applicable law (for instance, certain consumer protections under Irish law).
8. Limitation of Liability
To ensure we can offer EduEire at reasonable cost and continue improving it, we need to limit our legal liability for issues that might arise. Please read this section carefully:

Types of Damages: To the maximum extent allowed by law, Easy AI Ltd (EduEire) and its officers, employees, or affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, damages for loss of profits, loss of data, business interruption, goodwill, or other intangible losses arising out of or related to your use of (or inability to use) EduEire, even if we’ve been advised of the possibility of such damages. For example, we aren’t liable if a lesson plan output error somehow leads to a poor inspection review, or if an outage disrupts your planning and causes you inconvenience or reputational harm – those would be indirect consequences outside our direct control.

Direct Damages Cap: To the extent we are found liable for any claims, our liability will be limited to the amount you have paid us in subscription fees in the 12 months immediately preceding the event giving rise to the claim. If you have not paid anything (for example, if you are on a free trial or free tier), our total liability for any claim will be €0 (zero Euros). This means if something is our fault, the most we would compensate you is a refund of what you paid for the service for the last year, which is a reasonable estimate of your investment in our service.

No Liability for Content: We are not liable for content generated by the AI or user-provided content on the platform. While we try to prevent offensive or incorrect outputs, the AI may occasionally produce content that is unsuitable. You agree that we will not be held responsible for any such content or any actions you take in reliance on content from the service. For example, if the AI suggests an activity that is not safe or appropriate and you implement it without checking, we are not liable for the consequences – you must review and decide how to use the suggestions.

User Disputes: Easy AI Ltd is not responsible for any disputes or issues between users or between a user and a third party. If, for instance, two colleagues have a disagreement over content produced on EduEire, or if you share a lesson plan with someone and there’s an issue, that’s outside of our responsibility. We simply provide the tool.

Exceptions: Nothing in these Terms limits or excludes our liability for gross negligence, willful misconduct, fraud, or any other liability that cannot be excluded or limited under law. Additionally, your statutory rights as a consumer are not affected. For example, if Irish law provides certain remedies or minimum guarantees, those still hold. We do not seek to limit liability for death or personal injury caused by our negligence, though it’s hard to imagine how our tool could cause such physical harm – this is a standard legal clause.
Because our service is offered primarily to professionals (teachers) and not for ultra-hazardous uses, we expect the risk of serious loss to be minimal. Nonetheless, the above limitations are important to allow us to operate. If you are dissatisfied with any aspect of EduEire or these Terms, your sole and exclusive remedy is to stop using the service and (if applicable) cancel your subscription.
9. Termination and Suspension
We hope you love using EduEire, but should either of us need to end this relationship, here’s how that works:

Your Right to Terminate: You can stop using EduEire at any time. If you wish to delete your account, you may do so through the account settings or by contacting us at support@edueire.ie. Termination of your account will be handled in accordance with our Privacy Policy (we’ll delete personal data as requested, except as legally required to retain). Keep in mind, if you simply stop paying for a subscription, your account may revert to a free status (if available) rather than full deletion. If you want all your data removed, please explicitly request account deletion.

Our Right to Suspend/Terminate: We reserve the right to suspend or terminate your access to EduEire (or certain features of it) at our discretion, with or without notice, if we believe:

You have violated any provision of these Terms (e.g. misuse or non-payment). Minor breaches might result in a warning or temporary suspension; serious breaches (like attempts to hack the system or repeated abuse) can result in immediate termination.

Continued provision of service to you would be unlawful (for example, if sanctioned individuals or regions regulations apply, or if a court orders us to block an account).

It’s necessary to protect our platform or other users (for instance, your account has been compromised or is causing technical issues).

Effect of Termination: Upon termination of your account by you or us, your right to use the platform ceases. You should download or save any lesson plans or content you want to keep before closing your account, because afterwards you may not be able to retrieve them. We are not obligated to retain your content or data after termination, except as needed for our own records or backups as per our data retention policy.

No Refund on Termination: If your account is terminated due to breach of these Terms, you will not be entitled to any refunds for any remaining subscription period. If we terminate without cause (not due to your breach), we may offer a pro-rata refund for the remaining period of your subscription as a courtesy, but generally termination is aligned with your billing cycle (meaning you just won’t be charged further).

Survival: The provisions of these Terms that by their nature should survive termination (such as intellectual property rights, warranty disclaimers, limitations of liability, governing law, etc.) will remain in effect after termination of your account or cessation of use of the service.
We will try to be fair and provide notice where possible (for example, sending an email about an issue and a chance to resolve it before termination), but we also must protect the service and our business. If you believe your account was suspended or terminated in error, you can contact support to discuss it. However, please note that decisions regarding breaches are ultimately at our discretion.
10. Governing Law and Dispute Resolution

Governing Law: These Terms and any dispute or claim (contractual or non-contractual) arising out of or in connection with them or your use of EduEire shall be governed by and construed in accordance with the laws of Ireland. We choose Irish law because our company is based in Ireland and our service is tailored to the Irish education system.

Jurisdiction: You and Easy AI Ltd agree that the courts of Ireland will have exclusive jurisdiction over any disputes (unless otherwise required by consumer protection laws that give you the right to bring a claim in your home country). This means if there is a serious disagreement that leads to a legal case, it would likely be heard in an Irish court, under Irish law.

Consumer Rights: If you are using EduEire as a consumer (for example, a teacher subscribing individually, not a business transaction), you may have certain protections under consumer laws. Nothing in this section affects your rights to seek dispute resolution in the courts or venues as allowed by those laws. But generally, Irish and EU consumer law would also point you to Irish courts if we marketed and sold to you in Ireland. If you are based in another EU country, you might also have rights to resolve disputes in your local courts – EU consumer rules can be complex, but we are aiming to comply fully.

Informal Resolution: We truly value our relationship with our users. If you have any concerns or are considering legal action, we strongly encourage you to reach out to us first (info@edueire.ie or support@edueire.ie) to discuss the issue. Often, issues can be resolved quickly through communication, and we’ll make a sincere effort to address your complaints. We’re a small team and want our users to be happy; we will listen and try to find a resolution.

Alternative Dispute Resolution: As an online service, we also note that the EU provides an Online Dispute Resolution (ODR) platform (accessible at http://ec.europa.eu/consumers/odr) which consumers can use to resolve disputes regarding goods or services purchased online. While we hope to solve issues directly, this is an available resource. We are not obligated to use a specific ADR entity unless required by law, but we will consider it if it helps resolve a problem amicably.

11. Changes to These Terms

Updates: We may update or modify these Terms from time to time. Common reasons might be changes in our services, introduction of new features, or changes in law that require updates to our contractual terms. When we make changes, we will revise the “Last Updated” date at the top of the Terms. For significant changes, we will also provide a clear notice – for example, a banner on our site, or an email notification to the address associated with your account.

Acceptance of Changes: After we update the Terms, if you continue to use EduEire, that constitutes your acceptance of the revised Terms. If you do not agree to the new terms, you should stop using the service and, if necessary, cancel your subscription. We’ll always give a reasonable notice period for significant changes (typically at least 15-30 days) to allow you to review them and make a decision. Minor changes that do not materially affect your rights (like clarifications or typo fixes) may be effective immediately.

Review: It’s your responsibility to review the Terms periodically. We encourage you to check back on this page whenever you’re notified of an update. If you ever have questions about what a change means, feel free to contact us for clarification. Your feedback is also welcome if you think a term is unclear.

12. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy and any additional guidelines or policies we provide within the platform, constitute the entire agreement between you and us regarding EduEire. They supersede any prior agreements or communications (whether oral or written) relating to the subject matter. In plain terms, what’s written here is what we both agree to, and neither side is relying on any promise or representation that’s not written in these Terms or the Privacy Policy.

Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remainder of the Terms will continue in full force and effect. For example, if it turned out that under a certain law a particular limitation of liability is not allowed, that part would be struck or modified by the court, but the rest of the agreement would still apply.

No Waiver: Our failure or delay in exercising any right, power, or privilege under these Terms will not operate as a waiver of that right or acceptance of any modification of the Terms, nor will any single or partial exercise of any right or power preclude any further exercise of that right. In other words, if we don’t immediately enforce some part of these Terms, that doesn’t mean we’re giving up our right to enforce it later.

Assignment: You may not assign or transfer any of your rights or obligations under these Terms to anyone else without our prior written consent. Third-Party Beneficiaries: These Terms are not intended to give rights to anyone except you and us. No third party can claim any rights under these Terms, except as explicitly provided (for example, indemnified parties, or successors).

Force Majeure: We are not liable for any failure or delay in our performance under these Terms when caused by circumstances beyond our reasonable control, such as severe technical failures, internet outages, natural disasters, war, acts of terrorism, government actions, or pandemics. This clause means if something truly outside our control happens that prevents service (say, a massive power grid failure or an earthquake affecting data centers), we aren’t in breach of these Terms for not performing during that event.
